Cumberland County Fair Website

The purpose is to regulate the standards and manner in which events are conducted at the Cumberland County Fairgrounds including the Cumberland County Fair to ensure the protection of the public health, safety and welfare.

Licenses required.

No person shall conduct events at the Cumberland County Fairgrounds including the Cumberland County Fair unless licensed to do so by the City Clerk pursuant to this article.

A.  Cumberland County Fair. The person sponsoring the Cumberland County Fair shall obtain an annual license for its activities which license shall expire on December 31 of each year. The annual license fee shall be $1,500 payable when the application is filed.

B. Other events. A person sponsoring any other event at the Cumberland County Fairgrounds shall obtain a license for the event. The fee for the license shall be $250 per day payable when the application is filed.

C. Amusement games. No person shall operate an amusement game at the Cumberland County Fairgrounds unless licensed to do so pursuant to Article II of this chapter and the State Amusement Games Licensing Law, N.J.S.A. 5:8-100 et seq.

Applications.

The applications for the licenses shall be made in writing and filed with the City Clerk. Each application shall contain the following information:

A. Cumberland County Fair. The person sponsoring the Cumberland County Fair shall file the application at least one month before the date set for commencement of the Fair. The application shall include a schedule containing the names, addresses and proposed activity of each space lessee then known. This schedule shall be amended and updated seven days prior to the commencement of the Cumberland County Fair. The final schedule shall be completed by the commencement date of the Cumberland County Fair. The application shall also contain an estimate of the daily crowd expected at the Fair together with the security measures to be instituted for crowd control and traffic safety.

B. Other events. The person sponsoring any other event at the Cumberland County Fairgrounds shall file the application at least two weeks before the date set for the event. The application shall contain the name and address of the sponsor and the proposed activity. The application shall also contain an estimate of the daily crowd expected at the event together with the security measures to be instituted for crowd control and traffic safety.

C. Amusement games. Each person operating an amusement game at the Cumberland County Fairgrounds shall file the application at least three weeks before the date set for the event where the game will be operated. The application shall contain the name, address and social security number or date of birth for each operator of an amusement game together with the nature of each amusement game to be operated.


Approvals and inspections.

A. Approval of Cumberland County Fair Association. No event shall be held at the Cumberland County Fairgrounds without the prior approval of the Cumberland County Fair Association. This approval shall be submitted to the City Clerk before any license is issued.

B. Approval of the Board of Chosen Freeholders. No event shall be held at the Cumberland County Fairgrounds without the prior approval of the Cumberland County Board of Chosen Freeholders. This approval shall be submitted to the City Clerk before any license is issued.

C. Approval of State Department of Agriculture. Any association organized for the purpose of holding agricultural fairs and exhibitions must be approved by the State Department of Agriculture before it shall be eligible to be a licensee under the Amusement Games Licensing Law (N.J.S.A. 5:8-122). This approval is evidenced by a certificate issued by the Department of Agriculture which must be submitted to the City Clerk before any municipal amusement game license is issued.

D. State Uniform Construction Code. The Construction Official and Subcode Official shall make all appropriate inspections of the Cumberland County Fairgrounds to ensure compliance with the code and shall file an annual report with the City Clerk.

E. State Uniform Fire Code. The Fire Subcode Official and/or a Fire Inspector shall make all appropriate inspections of the Cumberland County Fairgrounds to ensure compliance with the code and shall file an annual report with the City Clerk

F. Crowd control and traffic safety. The application for the license for the Fair and the application for a license for any other event to be held at the Fairgrounds shall be referred to the Chief of Police, or his designee, for review and approval of the security measures to be employed for crowd control and traffic safety prior to the issuance of a municipal license by the City Clerk.

G. Criminal background investigation. The application for an amusement game license for each operator of an amusement game shall be referred to the Chief of Police, or his designee, for a criminal background investigation prior to the issuance of an amusement game license by the governing body pursuant to Article II of this chapter.
